Draft — pending legal review. This document has not yet been reviewed by counsel. The studio’s planned Texas LLC is not yet identified as a formed legal entity. Contract documents will be finalized before game distribution.
Pre-release draft. Declared Missing is in development. This document is a proposed game license, not a purchase offer or a license to an unreleased build. The final licensor’s legal name and terms must be supplied with the game before you are asked to accept them. Browsing this page does not accept a game license.
1. Scope and acceptance
This end-user license agreement concerns authorized copies of Declared Missing, including supplied software, updates and game content. Website use is covered separately by our Terms of Use. A distributor’s purchase and account terms may also apply. Any test-specific agreement must be shown before participation; confidentiality is not created simply by visiting this website.
2. License to play
Subject to the final agreement and lawful acquisition, the studio grants a limited, personal, non-exclusive license to install and play the game for personal entertainment on supported devices. The game is licensed, not sold as intellectual property. This license does not transfer ownership of characters, code, art, audio, branding or other content. Rights not granted remain with their owners. Mandatory legal rights and applicable open-source licenses are unaffected.
3. Eligibility and accounts
You must meet the applicable age requirement and have authority to enter the agreement. The website’s Media Gallery and signup forms require visitors to be 18 or older; final regional game ratings and store requirements remain pending. Keep any account credentials secure and report unauthorized access. Do not trade accounts, impersonate another person or use another person’s payment details without permission.
4. Fair play and restrictions
Do not use cheats, bots or unauthorized tools to gain unfair advantage, disrupt matches, bypass access controls or interfere with other players. Do not harass, threaten, discriminate against or expose private information about others. Do not distribute malware or exploit vulnerabilities against players or live services; report security problems privately.
Do not redistribute game builds or extract and resell game assets without permission. Do not reverse engineer, modify or circumvent protection mechanisms except where applicable law or an applicable license permits it. This clause does not restrict legally protected interoperability, security research or other non-waivable rights.
5. Online services and updates
Online play may require an internet connection, a supported platform account and compatible software. Connection charges are your responsibility. Updates may change balance, content, compatibility or service requirements. Development and test builds may contain errors, lose progress or be reset. Future features, dates, platforms and uninterrupted online availability are not promised by previews or roadmaps.
If services materially change or close, notice and remedies will be provided as required by applicable law and any purchase terms. This agreement does not remove statutory rights to conformity, repairs, refunds or other remedies.
6. Purchases and virtual content
No price, release purchase or paid entitlement is created by this draft. Any future sale must disclose its price, content, restrictions and applicable refund terms before checkout. Virtual items, if offered, have only the uses described at purchase and are not cash or a financial investment. Mandatory consumer rights and the relevant store’s refund process continue to apply.
7. Your content and feedback
You retain rights you hold in feedback or material you submit. Send only material you have permission to share. Voluntary suggestions may inform development without an obligation to implement them or pay for them. Any future feature that hosts player content must explain the permission needed to operate that feature before upload. This draft does not grant the studio ownership of unrelated work or permission to publish private support messages.
8. Privacy and safety
See our Privacy Policy for current website practices. Game-specific telemetry, voice communication, moderation and anti-cheat processing will require appropriate disclosure before those features collect data. Read the epilepsy and safety warning before viewing footage or playing.
9. Suspension and termination
Access may be restricted for a material breach, fraud, security threats or unlawful conduct, subject to applicable law. Where practicable and appropriate, the reason and a way to contact support will be provided. Urgent protective action may occur first. You may stop using the game at any time. On termination of a license, stop using unauthorized copies; rights or remedies that must survive under law remain available. Contact support@declaredmissing.gg to ask about an access decision.
10. Warranties and responsibility
Development builds are unfinished and may not work as expected. To the extent permitted by law, no additional promise is made that a test build will be error-free or continuously available. Nothing excludes liability that cannot lawfully be excluded, including applicable consumer guarantees, fraud or other protected claims. The final commercial agreement will state any further lawful limits; this draft does not impose an arbitrary damages cap.
11. Disputes and changes
The studio is based in Texas, United States, and intends to form a Texas LLC. The final contracting entity and any governing-law or forum clause will be confirmed before distribution. This draft imposes no arbitration agreement, class-action waiver or waiver of mandatory local protections. Contact legal@declaredmissing.gg for questions about this license or legal disputes. For gameplay or account help, contact support@declaredmissing.gg. Material license changes must be communicated and accepted where required by law. An invalid provision does not automatically invalidate the remaining lawful provisions.
